WHAT IS THE EB-5 PROGRAM?

The EB-5 Immigrant Investor Program is a U.S. federal immigration program that allows eligible investors and their immediate family members to apply for permanent residency through a qualifying investment in a USCIS-compliant project.

APPLICATION PROCESS

Document your source of funds and complete the investment

Your immigration attorney will help prepare the source and path of funds documentation required to demonstrate the lawful origin and transfer of your investment capital—an essential part of the I-526E petition process.

File Form |526E with USCIS 

Your immigration attorney will file your Form I-526E petition with USCIS. Investors already in the U.S. on a valid nonimmigrant visa may also be eligible to file Form I-485 concurrently, allowing them to apply for employment authorization (EAD) and advance parole while their Green Card application is pending.*

Receive conditional permanent residency

You and your eligible family members receive two-year conditional Green Cards, allowing you to live, work, and study anywhere in the United States. During the 90-day period before the cards expire, your attorney files Form I-829 to remove the conditions and obtain permanent Green Cards.

I-829 approval, permanent residency, and capital repayment 

Once the I-829 petition is approved, the conditions on your Green Card are removed and you and your eligible family members become lawful permanent residents of the United States. The invested capital may be repaid separately, subject to the project’s terms, performance, and applicable EB-5 requirements.
